Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Luma (“the Service”), a cloud-based property management system operated by Travel AI, Inc. (“Pebble House”, “we”, “us”, or “our”) and available at luma.mu. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Service Description

Luma is a cloud-based property management system designed for boutique independent hotels. The Service provides tools for managing room reservations, guest profiles, guest folio billing, restaurant and bar point-of-sale operations, and room status tracking. The Service is accessed through a web browser and requires an internet connection.

2. Eligibility and Access

2.1 Business Use

The Service is intended for use by hospitality businesses and their authorized staff. By using the Service, you represent that you are using it on behalf of a legitimate hospitality business.

2.2 Account Access

Access to the Service is by invitation only. A property administrator must grant you a staff role before you can access any Service features. We use Google OAuth for authentication — you must have a Google account to sign in.

2.3 Account Responsibility

You are responsible for maintaining the security of your Google account used to access the Service. You are responsible for all activities that occur under your account. Notify your property administrator immediately if you suspect unauthorized access to your account.

3. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws or regulations
  • Attempt to gain unauthorized access to the Service, other user accounts, or our systems
  • Interfere with or disrupt the Service or the servers and networks used to provide the Service
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use the Service to store or transmit malicious code, viruses, or harmful data
  • Use automated means (bots, scrapers, crawlers) to access the Service without our written permission
  • Sublicense, resell, or redistribute access to the Service without our written permission
  • Use the Service to store or process data unrelated to hospitality property management

4. Property Data

4.1 Ownership

You retain all ownership rights to the data you create and store within the Service, including guest profiles, reservations, folio records, menu items, and operational data (“Property Data”). We do not claim ownership of your Property Data.

4.2 License to Operate

You grant us a limited license to store, process, display, and transmit your Property Data solely for the purpose of providing and improving the Service. This license terminates when you delete your data or your account is closed.

4.3 Data Portability

You may request an export of your Property Data at any time by contacting us. We will provide your data in a standard machine-readable format within 30 days of your request.

4.4 Guest Data Responsibility

You are the data controller for personal information about your hotel guests that you enter into the Service. You are responsible for ensuring that your collection and use of guest data complies with applicable privacy laws in your jurisdiction, including obtaining any necessary consents from your guests.

5. Service Availability

5.1 No SLA

The Service is provided on an “as available” basis. We do not guarantee any specific uptime percentage or service level. We will make commercially reasonable efforts to maintain the availability of the Service but may experience downtime for maintenance, updates, or unforeseen issues.

5.2 Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify you in advance of material changes that affect your use of the Service.

5.3 Data Backup

While we maintain regular backups of Service data as part of our infrastructure operations, you are responsible for maintaining your own backups of critical business data. We are not liable for data loss.

6. Payment

If your use of the Service requires payment under a separate subscription agreement, the terms of that agreement govern billing, payment, and refunds. These Terms govern the use of the Service itself.

7. Intellectual Property

7.1 Our Rights

The Service, including its design, code, features, documentation, logos, and trademarks, is the property of Travel AI, Inc. and is protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

7.2 Feedback

If you provide us with feedback, suggestions, or ideas about the Service, you grant us an unrestricted, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that feedback into the Service without obligation to you.

8. Limitation of Liability

8.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

8.2 Limitation of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL TRAVEL AI, INC., ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (a) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (b) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (c) ANY CONTENT OBTAINED FROM THE SERVICE; OR (d) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR DATA.

8.3 Liability Cap

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (a) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, OR (b) ONE HUNDRED US DOLLARS ($100).

9. Indemnification

You agree to indemnify, defend, and hold harmless Travel AI, Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any applicable laws; or (d) your Property Data, including any claims that your Property Data infringes the rights of a third party.

10. Termination

10.1 By You

You may stop using the Service at any time. Contact your property administrator to have your staff role removed.

10.2 By Us

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Reasons for termination may include, but are not limited to: violation of these Terms, extended periods of inactivity, or discontinuation of the Service.

10.3 Effect of Termination

Upon termination, your right to access the Service ceases immediately. We will retain your Property Data for 30 days after termination to allow for data export requests, after which it may be deleted.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

11.2 Informal Resolution

Before filing any formal legal action, you agree to attempt to resolve disputes informally by contacting us at legal@luma.mu. We will attempt to resolve the dispute within 30 days.

11.3 Jurisdiction

Any legal action arising from or relating to these Terms shall be brought exclusively in the state or federal courts located in Delaware, and you consent to the jurisdiction of such courts.

12. General Provisions

12.1 Entire Agreement

These Terms, together with our Privacy Policy and any applicable subscription agreement, constitute the entire agreement between you and Travel AI, Inc. regarding the Service.

12.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.

12.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms without restriction.

12.5 Changes to Terms

We may revise these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.
